We request that you carefully read these terms and conditions of use of the Service Provider Catalog, hereinafter referred to as the Catalog. This document contains the informed consent for the users of this Catalog. Access to the Catalog is free of charge and does not generate any commercial, contractual, labor or professional relationship between its users and PROCOMER. Users agree not to enter or attempt to enter another user's account, falsify or attempt to falsify their identity while using the Catalog or any of the systems for which they have access permission.

The users of the Service Providers Catalog will be the legal entities interested in being part of it, hereinafter referred to as service providers, as well as the companies / investors interested in contracting services related to the installation and operation of a company in Costa Rica, hereinafter referred to as investors.

The Foreign Trade Promoter of Costa Rica (PROCOMER), whose main offices are located in Escazú, Plaza Tempo Building, lobby B, third floor, will store the data provided by the users in order to create the Investor Services Catalog. The administration of this Catalog is the responsibility of PROCOMER's Investment Management.

The purpose of the Catalog is to make available to investors a registry of suppliers capable of providing services related to the installation and operation of companies in Costa Rica, as a mechanism to strengthen foreign trade activities and attract foreign direct investment. This database will also serve to maintain contact with suppliers and users, as well as to gather general data for statistical purposes, generate reports and provide information, among other related aspects.

The data requested from suppliers is mandatory and must be provided in full. This information will allow filtering applications objectively and on equal terms to ensure reasonable suitability for use by investors.

By entering this website, users declare that the information provided is their own, current, accurate and true, so it is their responsibility to provide the information in those terms. Likewise, it is the responsibility of the users to make use of the information for the purposes proposed above.

The logo, name, brand, design and all graphics that identify PROCOMER and its various products and services belong to the Foreign Trade Promotion Agency of Costa Rica. The use, reproduction, copy or redistribution of them without written permission is prohibited. All other trademarks appearing on the site belong to their respective owners and their use, reproduction, copying or redistribution without the express permission of their owner is also prohibited. In the case of companies interested in being part of the Catalog of Service Providers that wish to present client portfolios, PROCOMER assumes that they are authorized to do so.

By the very nature of the Catalog, it is accepted that PROCOMER is authorized to share certain information about suppliers with other entities and the general public, such as, but not limited to: address, telephone, office location, e-mail, experience, description of services, resumes, logos, and photographs that are freely and voluntarily provided by the interested party in being part of the Catalog.

All information provided to PROCOMER and made available to third parties will be treated in accordance with the provisions of the Law for the Protection of Individuals with Respect to the Processing of Personal Data No. 8968, the Law of the System of Personal Data, and the Law for the Protection of Personal Data. 8968, the National Statistical System Law, No. 9694, the Law for the Protection of Citizens from Excessive Administrative Requirements and Procedures, No. 8220, the National Archives System Law, No. 7202, the Undisclosed Information Law, No. 7975, and its regulations and amendments, so as to prevent unauthorized dissemination of the data provided in order to avoid putting the platform at risk.

PROCOMER reserves the right to discard applications that do not comply with the minimum requirements to be part of the Catalog or that do not adequately complete the application data or its modifications.

It is the responsibility of the companies to keep their data and information updated.

Service providers registered in the Service Providers Catalog may exercise their rights of access, rectification, deletion and revocation of their data at any time.

PROCOMER reserves the right to establish, based on the information provided by the investment companies that have used the services of the suppliers registered in the Catalog and by means of objective mechanisms of qualification of the services offered, some type of ranking of the registered suppliers, without this being interpreted as a recommendation made directly by PROCOMER.

• Organize political or similar activities.
• Post content that defames or threatens other individuals or legal entities.
• Make statements that could be considered fanatical, hateful, racially offensive, or contrary to human rights.
• Encourage illegal activities.
• Infringe on the intellectual property of other rights holders, including but not limited to copyrights, trademarks, patents, industrial designs, trade secrets, or undisclosed information.
• Use material containing language or images that could be considered vulgar, obscene, or offensive.

No PROCOMER official shall have any responsibility for the use of the Catalog by users or suppliers registered in the Catalog. Users understand that the data provided in the Catalog is available to third parties, and that this initiative is an informative tool and does not imply for any reason a recommendation or specific advice by PROCOMER for investors or a priority order with respect to the companies registered in it.The persons who make use of this Catalog shall not have any action or right of claim against PROCOMER, its legal representatives, Managers, Directors, officers, employees, advisors and/or consultants, derived from any expense or cost they have incurred, or for any commitment or promise they have acquired on the occasion of the information contained in the Catalog, and therefore exempt and release them from any type of contractual, extra-contractual, criminal, civil and administrative liability that may arise from their relations; PROCOMER is a third party not involved, obligated or committed to do or not to do something specific. By virtue of the above, investors, supplying companies and users in general understand that they will not have the right to claim indemnifications, claims or complaint management from PROCOMER, related to any decision taken based on the content or information of the Catalog. In particular, PROCOMER shall have no obligation or liability for any damages caused by the use of the Catalog, including, but not limited to, claims for damages, defamation, errors, loss of data, poor quality or not fully performed services, civil, criminal, administrative or extra-contractual liability.

The users of the Catalog assume full responsibility for any communication, negotiation, commercial relationship, actions and contracts they carry out or intend to carry out with the legal entities registered in it. By virtue of the above, PROCOMER will not have any type of responsibility for this type of operations, therefore it is expressly stated that PROCOMER will not act as negotiator, mediator, facilitator or any other analogous figure between the parties, since its role is only to collect the information of the Catalog, without being able to claim any type of responsibility for this fact alone. The same rules shall apply in the case of registered suppliers who feel harmed by the company that intends to or has used their services.

Users of the Catalog agree to use the information only for reasonable, proportionate and lawful purposes. In case of agreement with the above, if a third party claims that any material published in the Catalog contravenes the reasonable, proportional or legal use, it will be the responsibility of the user who considers himself/herself affected to take the corresponding actions to establish the normal use of the information existing in this Catalog. PROCOMER has the right to remove material from the site, block access, or take any other action with respect to the published material, at its discretion, although it is not obligated to do so. Likewise, PROCOMER is under the obligation to comply with the corresponding judicial or administrative orders regarding the information or use of the aforementioned Catalog.

Any controversy or conflict that may arise as a consequence of the use of the Catalog will be resolved in accordance with the legislation in force in Costa Rica, submitting to the jurisdiction and competence of the courts of Costa Rica, expressly waiving any other jurisdiction that may correspond.

PROCOMER will not charge or accept to receive any type of monetary or in-kind sum to be part of the Catalog. PROCOMER will not charge or receive any sum of money or in kind from the companies that use the Catalog.

Once the conditions of use of the Catalog have been detailed, I consent to the existence of a database that is stored by PROCOMER to support the operation of the Catalog, as well as the treatment that this information will receive, I give my informed consent for my information to be used in the manner described in these conditions of use, expressly accepting the limitations of liability and other conditions detailed above".
